The buyer occupies the property and has for 20 years There is an escrow set to close in 60 days.however there were NUMEROUS improvements to the property that had to be done to make it lendable.which the buyer has done with his own funds the seller had termite work to complete which is still not complete. closing was delayed due to this and was mutually agrreed on a specific date. then buyer was givin notice to perform meaning loan approval within 15 days and docs in escrow within 21 days. formal loan approval was not done by the 15th day but loan docs were ready and at escrow on 19th day. however on the 15th day the seller has tryed to cancel escrow because prices have gone up and he can get more for the property cause values are still rising and since all improvements have been done. he is claiming buyer did not fullfill notice to perform any comments about who you think will prevail in arrbitration
