We are looking at a lake home FSBO. The owner is using an MLS. They have listed the home as 3BR. It is a walkout rambler. One bedroom in the basement has built-in bunkbeds and although not real bigg has the appearance of a bedroom. However the egress window appears to not meet egress requirements. The bottom is higher than 46 inches, there is not permanent step under it, and it is a crank out hopper (ranch) window that hinges on the top. I am not sure of the dimensions of the window and have not verified that it opens to 90%. It also opens to what equates to a crawwl space under a deck (obviously added later).
We do not have a signed agreement yet. They have reduced their price about 12% in the last 4 months to get to our proposed price. They do not appear to be aware that the bedroom is not a 'legal' bedroom.
Question? Assuming that we have both been negotiating on the 3BR assumptin, how much of an impact should this have on my offer?

It sounds like your seller has already reduced their price considerably, however, bringing this discrepancy to their attention will probably save you quite a bit more money. Because you are dealing with an independant seller negotiations will be quite open so milk this point for all it is worth. Chances are the person you are dealing with just wants to close the deal as soon as possible, so see what they are willing to do for you.
