I am buying a home and don't know what to do. The agreement said the closing date would be on or before Sept 24th. So when it was moved up to the 10th, I was excited to get moved in early. The bad news was that the renters would need more time to move out, so it got pushed back to the 17th, then back to the 24th. As you can see, the 24th has passed by and now the closing is supposed to take place on Oct 1st, but even that looks questionable. The problem is that there are renters in the home (on HUD) and they are waiting for a home that they are planning to move into to be empty. They were given plenty of time, and a 30 day notice, but they are still there. I like this house and everything, I just feel like I am being jerked around and wonder if there is anything I can do since the seller didn't get them out by the time the agreement stated?

Maybe you need to give your seller an ultimatum. Tell them you need the renters out by the last day of September or else you will walk away from the deal. The bottom line is that the renters where obviously told that the house was for sale so they should have been making arrangements to move out.

Renters Rule - Your agent should have made sure your offer asked for Vacant Possession and if not, then you are assuming the tenants. If you close(d) the deal then it is your responsibility to have the tenants removed by whatever means are at your disposal. You may have recourse on your Agent – see a lawyer.
