My house was on market for 1 month before I got an offer. Buyer wrote check for 1000$ dollars as earnest deposit. As closing date approached Buyer asked for extension because original bank didn’t give him money. After 15 days extension he just walked away because second bank gave him much higher interest rate and he wasn’t interested. After that I put my house back on market and was able to sell it in 2 months for same price. As result I had to carry payments for 4 month while house was vacant. I know that buyer will lose his earnest deposit (according to contract) but will I be able to sue buyer for damages (extra 2 or 4 month payments) If so would I need a lawyer or just take him to the small claims court. And if I do need a lawyer who would pay lawyers fee if I win.
