My husband and I want to sell our home because the area across the street has been rezoned for commercial space. We know this because my husband is a city planner. Do we have an obligation to tell potential buyers about this?

There is something called diclosure, that, if they ask you must tell them. Ohter than that you are under no obligation. If they have done their research they would no about the rezoning. The ethical dilema is up to your soul to decide.

I believe that disclosure only has to do with the condition of the house you are selling (ie. you have to tell prospective buyers about infestations, leaks, damage etc.). If you really want to sell your home plead ignorance when it comes to the rezoning. Chances are that your buyer won't realize this is going on till they've already moved in.

It would depend on the state you are living in - In California you would be required to disclose.

Of course you should tell any prospective buyer about area influences. Ask yourself... "Would I want to know about this?" Let you conscience be your guide.
