my parent,s property was subject to order of sale by auction.there is existing bank loan.i managed to sell the property 1 month before the auction date and collected the earnest money.i then informed the bank that the property was sold and to cancel the auction.in the midst of preparing the sale & purchase agreement it was found that probate of my deceased father was not obtained.later purchaser was informed of all the above.i had asked him if he wants to proceed with his purchase and he said he wanted to and asked me to proceed despite that his lawyer had advised him against it.he even wanted to pay cash should his bank loan be delayed.now 2 weeks later he backs out stating that his lawyer advised him not to proceed with the purchase and he now wants refund of his earnest money.
